Wedding Photography - Terms and Conditions

CONFIRMATION OF RESERVATION: Reservation is only confirmed upon receipt of non-refundable deposit (20% of the agreed fee) but subject to the terms set out in the "Payment Schedule" paragraph.

SAFETY: The photographer reserves to right to terminate coverage and leave the location of the event if the photographer experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the event; or in the event that the safety of the photographer or the photographer's equipment in question.

SHOOTING TIME / ADDITIONS: The client and the photographer agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties. Shooting commences at the requested start time and ends at the requested end time. If the client does not arrive at the appointed time for the event, shooting will commence at the scheduled start time and end at the scheduled end time.

EXPENSES INCURRED: All travel is included in the agreed photographer fee for weddings within a 50 mile radius of the NE63 postcode. Weddings outside of this radius may incur an additional mileage fee but this will be confirmed with the client. No additional travel expenses incurred by the photographer will be charged to the client unless the client changes the venue of the event which ends up being outside of the 50 mile radius.

VENUE AND LOCATION LIMITATIONS: The photographer is limited by the rules and guidelines of the location and site management/rules of the venue. The photographer will visit the venue prior to the event to establish familiarity but access to all areas of the venue may be restricted. The number of photos delivered may be influenced by the conditions on the day (eg. weather, lighting of rooms etc.)

PACKAGE DETAILS:

  • Photography coverage from the photographer (times agreed between the photographer and the client as per the above).
  • Post production and editing services of all useable images. The final post production and editing styles, effects, and overall look of the images are left to the discretion of the photographer.
  • Online password protected gallery of images available approximately 6-8 weeks after the event (subject to workloads). The photographer will share the password with the client only and it is at the client?s discretion whom they share the password with.
  • All usable images to be provided in high resolution JPEG files in both colour and black and white (at discretion of the photographer).
  • The photographer will not supply RAW files under any circumstances, only final edited JPEGs of useable images.
  • Smaller files can be provided for easy uploading to Social Media/email containing company watermark.
  • Full printing rights (including certificate from the photographer if required) is given to the client to enable reproduction of the images. Copyright and ownership of the images remains with the photographer. The photographer can provide prints, albums, canvases and other merchandise at an additional cost.
  • 1 x USB Stick will be provided to the client by the photographer containing the abovementioned images or a secure download link can be provided.
  • Images will be backed up by the photographer and stored for a minimum of one year from the event date.
  • Albums, canvases and other merchandise are not included in this package. However, these can be provided at extremely competitive prices (please ask for price list). All merchandise purchased is produced in professional labs to ensure the highest possible quality.

PAYMENT SCHEDULE: A 20% non-refundable deposit secures the booking. Full payment to be made no later than four weeks before the date of the wedding by cash, cheque or bank transfer. The photographer reserves the right to terminate this agreement should the balance not be paid by this date and retain any payments made to date or apply interest on any outstanding balance should the balance not be cleared 28 days before the wedding. Should the photographer shoot the wedding with the balance not being cleared, proofs/images will not be released until 7 days after the balance is settled.

An invoice will be issued prior to the balance being due and a receipt can be provided on request. Payments can be made in instalments at no extra cost providing the balance is cleared no later than 28 days before the wedding.

Payments for additional items such as additional prints, albums and other media must be paid in full at the time of order. No orders will be placed with suppliers until the payment is received in full.

SOLE PHOTOGRAPHER: The photographer shall be the only paid photographer that the client uses for this event. The photographer accepts there will be guests with cameras at the event, but reserves the right to politely ask guests to step to one side if they obstruct the photographer, particularly during any formal shots.

LIMIT OF LIABILITY: In the extremely unlikely event that the photographer is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of the photographer, the photographer will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event. Where an event has been cancelled/postponed under circumstances out of the control of the photographer, the photographer agrees to transfer the date to a newly agreed date where availability allows. Should the photographer be unavailable for any rearranged date, the sum returned shall be no more than the agreed fee. Should the event be cancelled by the client or in events outside of the control of the photographer and not rearranged, the photographer shall retain any payments made to date.

In the extremely unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the photographer?s control, including but not limited to camera, hard drive, or equipment malfunction, the photographer?s liability is limited to the return of all payments received for the event. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. The photographer is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or one year.

SOCIAL MEDIA AND MARKETING: The photographer may use a selection of images for marketing and social media purposes. Should you wish this not to be the case, please send an email stating you wish photos not to be uploaded to social media or used in marketing material.

PERSONAL DETAILS: Your personal details are held purely for the purposes of the photographer and will not be shared with any other party.
